An appellate court in Australia denied an appeal filed by Erin Patterson, a woman convicted of murdering three relatives with death cap mushrooms. The high-profile trial, which captivated the nation and inspired various media productions, concluded with judges rejecting Patterson's bid to overturn her conviction and simultaneously imposing a stricter sentence that renders her ineligible for parole.
Patterson, 52, was originally sentenced to life in prison with the possibility of release after 33 years. She was found guilty of killing Gail and Don Patterson, as well as Gail's sister Heather Wilkinson, who died days after consuming a beef Wellington lunch prepared by Patterson in Leongatha, Victoria, in 2023. The court also convicted her of the attempted murder of Ian Wilkinson, Heather's husband, who survived the poisoning and later testified at the trial.
During the appeal proceedings, Patterson's legal team argued that the jury was not sufficiently sequestered, that prejudicial evidence was admitted, and that the prosecution overreached in its closing arguments. They maintained that the deaths were a tragic accident rather than intentional acts. However, the court dismissed these claims, finding no improper interaction between the jury and others staying at the same hotel and ruling that the contested evidence was appropriate for the circumstantial case presented by prosecutors.
Prosecutors had also appealed Patterson's original sentence, describing it as manifestly inadequate given the truly dreadful nature of the crimes. The judges agreed, stating that the initial sentence failed to reflect the calculated criminality involved. They noted that Patterson's intent persisted for over two weeks from the time she issued the lunch invitation and that she allowed her victims to suffer for a week after the meal without seeking help.
Justice Stephen McLeish, delivering the ruling from the bench, characterized the offending as extraordinarily cold and calculated, stating it must be denounced in the strongest terms. The victims included Patterson's estranged husband Simon Patterson's parents; Simon had been invited to the lunch but canceled the night before due to prior disagreements with Erin regarding their children and finances.
